Joshua B. Alper is a Partner in the Morgan & Morgan Business Trial Group and based in the firm’s Miami office. Mr. Alper’s primary practice areas include complex commercial litigation and bankruptcy law. He has significant litigation experience in both state and federal courts, representing clients in a wide range of matters.

Mr. Alper focuses his practice on contingency-fee business litigation, which enables him to vigorously advocate his clients’ interests, ensuring that wealthier individuals or companies do not have a competitive advantage due to their unlimited legal resources. He firmly believes the final outcome of a case should not depend on whether a party is well-funded, but should be dictated by the merits.

His experience spans the spectrum of disputes that arise in the commercial litigation context, including complex breach of contract cases, fraud, breach of fiduciary duty, shareholder actions (both direct and derivative), non-compete matters, misappropriation of trade secrets, tortious interference, writs of garnishment and replevin, securities litigation, as well as disputes under the Uniform Commercial Code.

As part of Mr. Alper’s federal court practice, he also has significant experience representing secured and unsecured creditors in bankruptcy court in adversary proceedings and contested matters under Chapters 7, 11, and 13 of the Bankruptcy Code. In this connection, he has handled the prosecution and defense of preference and fraudulent transfer actions, and has been involved in contested confirmation hearings.

On numerous occasions, Mr. Alper has been named a Florida Super Lawyer “Rising Star,” which recognizes the top 2.5% of lawyers in the State of Florida under the age of 40. He also has been fortunate to be selected by the South Florida Legal Guide as a “Top Up and Comer.” He was nominated by his peers and his credentials were carefully vetted based strictly on merit. In 2018, Attorney at Law Magazine selected Mr. Alper as a “Rising Star,” and featured him in an article about legal strategy and practical skills.

Prior to joining the firm’s Business Trial Group, Mr. Alper honed his legal skills at some of Florida’s most prominent law firms. He was also part of a trial team that obtained a jury verdict in excess of $66 million in damages and interest against one of the nation’s largest financial institutions. The case involved misconduct by a bank that caused a real estate developer to lose the entire project.

Mr. Alper is a results-oriented problem solver who is frequently called upon to assist clients in difficult and unique situations, providing assistance to achieve the best outcome.

He graduated with honors from the University of Michigan and graduated law school from Nova Southeastern University, Shepard Broad College of Law. During law school, Mr. Alper was a member of the Nova Law Review.

William is co-managing partner of the Morgan & Morgan Business Trial Group and manages the Firm’s West Palm Beach office.  His practice is dedicated to complex business litigation and he has successfully represented clients in a wide-variety of industries and disputes.

William litigates business cases on a contingency-fee basis, representing companies and individuals with meritorious claims that have been damaged due to the misconduct of larger, wealthier, or insured parties.  He is driven by the philosophy that justice requires cases to be decided on the merits, not by the size of a corporation or insurance company’s legal budget.

William has been named by U.S. News & World Report as one of The Best Lawyers in commercial litigation and professional malpractice.  He has been honored as Florida Trend Magazine’s Florida’s “Legal Elite”; Florida Super Lawyers “Rising Star”; Palm Beach Illustrated’s “Top Lawyers”; and South Florida Business Journal’s 40 Under 40.

The true measure of his success, however, has been the results he has achieved for his clients. William is a proven trial lawyer, having won multiple jury trials, bench trials, and arbitrations in cases involving contracts, employment, partnerships, real estate, and securities, among others.  He has also recovered millions of dollars through settlements in state and federal courts, as well as arbitration forums, throughout Florida.

William is the President-Elect of the University of Florida Law Alumni Council.  He has been appointed to multiple terms on the Florida Bar’s Committee on Professionalism, and has been the chair of the Palm Beach County Bar’s Circuit Court Civil Committee and  Business Litigation Committee. William is a frequent speaker on issues involving business and securities litigation, including to groups such as the American Bar Association and the Florida Justice Association.

Prior to joining the Business Trial Group, William prosecuted large-scale claims for a well-known securities and antitrust firm.  He also interned at the U.S. Attorney’s Office and the State Attorney’s Office, where he first-chaired multiple jury trials.  Before becoming an attorney, William received an MBA in finance and securities analysis and worked at a hedge fund.
