The husband’s brother argued that the “intestate” estate (property without a will) should pass solely to him, since the husband died while he and his wife were undergoing divorce proceedings and had, in fact, entered a partial settlement agreement disposing of some marital property.

BTG Files Lawsuit on Behalf of Caregiver Alleging Failure to Pay for Years of Around-the-Clock In-Home Care

The Business Trial Group (“BTG”) filed a lawsuit in Essex County, Massachusetts, against Mark Fagan and Joanne Fagan, alleging that Eugenia Subero has not been fully paid for more than seven years of 24-7 in-home care she provided to the defendants’ mother, an elderly dementia and Alzheimer’s patient.  The lawsuit asserts damages for unpaid compensation in excess of $560,000.

The Business Trial Group won the appeal of the jury verdict awarded to its client Alaqua Lakes Community Association for defective roads in the luxury community, leading to an $8.6 million recovery.

On August 4th, 2020, Florida’s 5th District Court of Appeal denied the appeal of developer Taylor Morrison. The court entered a per curiam affirmed (PCA) decision, ruling in favor of Alaqua Lakes.  A PCA indicates that the points of law raised in the appeal are so well-settled that further writing would serve no useful purpose.
